WARRANTY

JMA Attachments (“JMA”) is dedicated to delivering exceptional products to our valued clients. We provide a limited warranty for all our merchandise, ensuring they are free from defects in material and workmanship when put to normal use and appropriately maintained for the warranty period as outlined below. We take pride in our commitment to quality and stand behind our products to ensure customer satisfaction.

Warranty Period

The warranty period for all JMA Attachments products is two (2) years from the date of purchase by the original purchaser. “Please pay attention that the warranty does not cover wear parts”.

Coverage

If any JMA Attachments product is found to have a defect in material or workmanship during the specified warranty period, JMA reserves the right to repair or replace the product, subject to the conditions and limitations outlined in our warranty policy.

In accordance with the terms of this warranty, any product that undergoes repair or replacement will only be eligible for warranty coverage during the remaining duration of the original product’s warranty period. It is important to note that the warranty coverage is not extended or renewed beyond the original warranty period.

Warranty Claim Procedure

In order to submit a valid warranty claim, the individual who owns or purchased the product must adhere to the following guidelines:

  1.  The claim must be notified to JMA Attachments within the designated warranty period, and no later than ninety (90) days from the date of the reported product failure.
  2.  The claimant must provide sufficient information to substantiate the claim, which includes evidence of purchase, product specifications, and a comprehensive description of the defect or failure.
  3.  The claimant must make the product accessible for inspection by JMA Attachments, if requested.
  4.  The claimant must cooperate with JMA Attachments during the claim investigation.

Failure to comply with these requirements may result in the denial of the warranty claim.

Warranty Reimbursement and Limitations

Upon receipt of a legitimate warranty claim, JMA Attachments shall exercise its discretion in accordance with its policies and procedures to provide resolution as:

  1.  Replace the product, or
  2.  Provide payment for the parts and labor necessary to repair the product.

JMA Attachments would like to inform you that we cannot be held liable for any expenses or costs resulting from the repair of our products by third parties without our prior written consent. We kindly request that any repair work be done by authorized personnel only.

Exclusive Remedy

The remedy of repairing or replacing any product under the terms of this warranty is exclusive to the owner/purchaser and is considered in lieu of any other remedy. JMA Attachments shall not be held liable for any special, consequential, or incidental damages arising from any claimed breach of warranty or for any delay in the performance of this warranty.

Warranty Exclusions

This limited warranty excludes the following:

  1.  Products that have been subjected to accident, damage, negligence, abuse, or misuse.
  2.  Products that have been improperly assembled, installed, or maintained.
  3.  Products used in abnormal operating conditions or for purposes other than those for which they were designed.
  4.  Products that have been altered or modified.
  5.  Normal wear and tear of the product due to regular use.

It is important to note that these exclusions are not meant to be exhaustive, and other circumstances may also result in the warranty becoming void. The warranty is also subject to certain limitations and conditions, which are outlined in the accompanying documentation. Please refer to the warranty documentation for further information and contact us if you have any questions or concerns about the warranty coverage.

No Modification, Extension, or Transfer

The terms outlined in this limited warranty are non-negotiable and cannot be modified or extended by any party. It is important to note that the warranty is non-transferable and is only applicable to the original retail purchaser who acquired the product directly from JMA Attachments. It is imperative that subsequent product owners or users are aware that this warranty is exclusively available to the original purchaser.

Dispute Resolution

Any disputes that may arise from or be related to this limited warranty shall be settled through binding arbitration, pursuant to the Federal Arbitration Act and administered under the Commercial Dispute Resolution Procedures of the American Arbitration Association. This arbitration process will be conducted by a neutral arbitrator selected by the parties, and the arbitrator’s decision will be final and binding. The parties involved in the dispute will share the costs of the arbitration equally, except as may be prohibited by law.

Governing Law

This limited warranty and the legal relationship between the parties shall be subjected to the jurisdiction of the laws of the State of Florida and the United States, without giving effect to any choice of law or conflict of law provisions.
